Should you become unable to do so, your Powers of Attorneys allow you to speak while alive. It is important that you place any conditions and restrictions on the use of both your Power of Attorney for Health Care and for Property. However, the second you die; these documents are no longer valid and you require a Last Will and Testament to speak for you from beyond the grave. It is of the prime importance that your minor children be placed in the care of those you would choose; and not someone that a Court who may be unaware of your wishes deems to be “in the best interest of the child”. It is also extremely important that your hard-earned assets are given to those you would wish, and that these gifts be given in a clear and concise manner—so as to avoid Costly and Unnecessary litigation.
